Conditions of entry Tank A Day Challenge
1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this competition is deemed acceptance of these Conditions of Entry by each entrant and each student participant. Entry is via Internet or mail only.
2. Any costs associated with accessing the competition website remain the responsibility of each entrant and student participant and are dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid and will result in an ineligible entry.
3. Entry is open to all primary schools in Australia.
4. To enter the competition:
a. The Principal of the participating school must first, during the competition period, log on to www.tankaday.com.au and complete in full and submit in the manner required the online registration form. In order to fully complete their entry, the Principal will be required to provide their full name, the name, address, telephone number, facsimile number and email address of the school, the total number of students at the primary school and the number of classes at the primary school. The Principal will also be required to provide a response to the question, “in 200 words or less, tell us about your water story, and why water is important to your school”; and then
One or more students at the participating school must participate in the competition by logging on to www.tankaday.com.au and completing in full and submitting in the manner required the Water Saving Quiz OR completing in full a hard copy of the Water Saving Quiz and mailing it to BlueScope Steel Tank A Day, Reply Paid 65101, Steel Direct, Locked Bag 8825, WOLLONGONG DC NSW 2500.
b. In order to properly complete the Water Saving Quiz, all 7 questions of the quiz must be correctly answered. In order to fully complete their entry, the students will be required to select their school and provide their class number/name. Students are not required to enter any personal information.
5. Each Principal and student may only enter the competition once during the competition period. The Promoter accepts no responsibility for late, lost or misdirected entries. Incomplete, ineligible or incomprehensible entries will be deemed invalid. Entries must be received by the Promoter during the competition period. Entries received will be considered final by the Promoter. Internet entries will be deemed to be accepted at the time of receipt and not at the time of transmission.
6. Competition commences at 9:00am (AEST) on 4/8/2008 and closes at 5:00pm (AEST) on 17/08/2009. The prize judging will commence on 02/09/2008. Prize judging will occur at BlueScope Steel Limited, Level 11, 120 Collins Street Melbourne; IM Advertising, Level 2, Suite 222, 4 Hyde Parade, Campbelltown NSW 2560; or such other address as may be advised on the competition website from time to time. Every Tuesday of each school week between 02/09/2008 and 17/08/2009, the Promoter will select five (5) primary schools that will be deemed the winning schools for that school week. School day winners will be judged on the basis of the highest student participation rates (which shall include entries from previous school days during the competition period) accumulated on a given school day as well as originality and creativity of the Principal’s response on the online registration form. Student participation rates are calculated based on the number of students within each school who have submitted the Water Saving Quiz in comparison to the total number of students within each school, expressed as a percentage. Chance plays no part in determining the winners. All eligible entries received will be judged by a panel of appropriately qualified judges from BlueScope Steel Corporate Affairs and/or IM Advertising. Judging will cease over the school holiday period and on public holidays (based on the NSW school calendar).
7. Winning primary schools will be announced on The Today Show and will be notified by telephone and mail. Winning primary schools may also be announced on the competition website from time to time, in the Promoter’s sole discretion. All reasonable steps to notify winners of the results of judging will be taken by the Promoter. Judges' decision is final and no correspondence will be entered into.
8. 200 prizes will be given away throughout the competition period. The school judged to be the winner for a given school day during the competition period will each win one (1) 27,000 litre Pioneer GALAXY® rainwater tank and pump, valued at up to $5542.00 (Recommended Retail Price including GST). Winners will also receive one (1) “Winners Pack” containing a Torch Keyring, Water Friendly Seedsticks and letter to parents to be distributed to each student at the winning schools, valued at up to $14.95 (Recommended Retail Price including GST).
9. Total prize pool value of all rainwater tanks is up to $1,108,400.00 (Recommended Retail Price including GST). Prizes are not exchangeable or transferable and cannot be taken as cash. The Promoter accepts no responsibility for any variation in prize value.
10. Rainwater tanks will be delivered at no cost to each winning school by a BlueScope Water representative (or their agents) and the tanks will be constructed on a prepared site. The Promoter will work with each winning school to prepare the necessary downpipe connection to render the tank functional. The Promoter will also provide technical advice and support to the winning schools. The prize excludes installation and maintenance costs, which will be the responsibility of the winners. A BlueScope Water representative will contact the winners to discuss installation options after the prize has been awarded.
11. In order for the rainwater tanks to be installed, the winning schools must comply with the Promoter’s requirements. These include that the schools must have clean gutters in good working condition; have a 6 x 6 metre levelled site prepared with 150mm of clean sand adjacent or within 10 metres of the school building; and the school’s gutters must fall toward the downpipe location to ensure water flow during a rainfall event. The Promoter recommends that there is a power outlet near the site for the pump for the rainwater tank.
12. Each participating school may only win one prize during the competition period. Entries for a given school day that are not judged as the winning entry for that school day are eligible to win on subsequent school days.
13. The Promoter reserves the right to request the Principals of the winning schools to produce (within the requested time) appropriate identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the Principals’ identity and the winning schools’ eligibility to enter and claim a prize and any information submitted by the Principals or students in entering the competition, before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entry has not been verified or validated to the Promoter’s satisfaction within the time requested, that entry will become invalid. All prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
14. If for any reason a prize becomes unavailable due to circumstances outside of the Promoter's reasonable control, the Promoter reserves the right to award a similar prize of equal or greater value.
15. The Promoter and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with using any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
16. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Conditions of Entry, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
17. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this competition if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including without limitation technical malfunctions or failures.
18. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
19. Caution: any attempt to cause malicious damage or interference with the normal functioning of the competition website or the information on the website, or to otherwise undermine the legitimate operation of this competition may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these conditions of entry or any other legal obligation by an entrant, the entrant agrees to indemnify the promoter for those losses, damages and costs.
20. The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's mobile handset or computer related to, or resulting from, participation in this competition or the downloading of any materials related to this competition.
21. If for any reason this competition is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the competition, subject to any applicable legislation.
22. All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the competition and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the competition. The personal information collected will not be used for any purpose other than is required for this competition and to announce the winning schools on The Today Show and the competition website and will not be disclosed to any third parties. Entrants can gain access to, update or correct any personal information by completing the ‘Contact us’ form available on www.tankaday.com.au. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
